JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act.

Allegation against the petitioner is that he was apprehended at the railway station and from his possession ganja was recovered.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 1.2.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. As per prosecution case, 11 kg. 300 gm. ganja is said to have been recovered from the possession of the petitioner, same is much less than the commercial quantity.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.39946 of 2015 (3) dt.14-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Ist Addl. Sessions Judge, Saran at Chapra, in connection with Chapra Rail P.S. Case no. 6 of 2015.
