The petitioner has prayed for issuance of an appropriate writ in the nature of Mandamus for commanding the Respondent nos. 1 to 6

Patna High Court CWJC No.3058 of 2019(2) dt.26-02-2019 2/2 to remove the encroachment made by Respondent Nos. 7 and 8 who have encroached the public land appertaining to Khata No. 146, Plot No. 364, measuring an area of 240 sqr. ft or 1⁄2 decimals and Khata No. 146, Plot No. 364, measuring an area of 0.3 decimals which has been used as rasta and drainage by public in general and the same have been encroached by the Respondent Nos. 7 and 8 respectively situated at Mauza Kheladiya, P.S. and Anchal- Karakat, DistrictRohtas by using muscle and money power and in collusion with officials of the Gram Panchayat and have constructed houses over the same.

It has been submitted on behalf of the petitioner that Encroachment Case Nos. 17/2005-06 and 09/2006-07 were initiated against the encroachers and a final order was passed on 16.03.2007. In spite of the same, the public land in question is still under encroachment.

If so advised, the petitioner may file an application under Section 7 of the Bihar Public Land Encroachment Act for redressal of his grievance.

With the aforesaid observation/direction, the present writ application stands disposed of.
