The petitioners seek bail in Hathauri P.S. Case No.34 of 2019 registered for the offence punishable under Sections 272, 273, 467, 468, 420, 120(B)/34, 270, 228, 471, 472 and 419 of the Indian Penal Code, Sections 4/6 of Trade Marks Act and Sections 30(a)/32(ii), 35(c), 36, 38(i)(ii) of the Bihar Prohibition and Excise Act.

The police has arrested several persons on the allegation of recovery of huge quantity of illicit liquor and the petitioners are also named accused in the F.I.R. Submission of learned counsel for the petitioners is that the petitioners have been falsely implicated in this case having

Further submission is that Section 100 of the Code of Criminal Procedure has not been followed. It is submitted that several co-accused persons have already been granted bail by this Court vide Cr.Misc.No.47975 of 2019, Cr.Misc.No.56872 of 2019 , Cr.Misc.No.71513 of 2019, Cr.Misc.No.70294 of 2019 and Cr.Misc.No.85972 of 2019 by this Court.

Heard learned Addl. Public Prosecutor.

Considering above facts and circumstances of the case as well as nature of allegation, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S. Case No.34 of 2019 .
