1. The petitioner apprehends his arrest in connection with Aurangabad Complaint Case No. 80 of 2023 dated 14.03.2023 registered under Section 498(A), 379, 420 of the I.P.C.

2. The prosecution case is that marriage of the complainant was solemnized on 08.06.2022 with the petitioner in accordance with Hindu rites and rituals in which 8 decimal land and Rs. 100000/- was given as gift but soon after marriage the accused persons started demanding bike and due to non fulfillment of the same the complainant was tortured physically and mentally. On the fateful day of 20.10.2022 the accused persons ousted the complainant from her matrimonial home.

3. Mr. Bachan Jee Ojha, learned counsel for the petitioner

Patna High Court CR. MISC. No.7665 of 2025(3) dt.13-05-2025 2/3 submits that petitioner is innocent and he has falsely been implicated in this case. In paragraph no. 7 of the bail application it has categorically been stated that the complainant did not want to marry with the petitioner but her family members forcibly solemnized the marriage as such she is reluctant to reside in her matrimonial home. The marriage was solemnized in a temple without any dowry and the allegation of torturing and demanding dowry is absolutely false and concocted. In paragraph no. 9 of the bail petition it has been stated that the petitioner is ready to settle the matter with the complainant in accordance with her desire.

4. No one appears on behalf of the opposite party no. 2 despite service of notice.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that there is non appearance on behalf of the opposite party no. 2 despite service of notice, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with
