JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and Mr. Lakshmi Kant Sharma learned A.P.P. for the State. The petitioner seeks bail in connection with Special Case No. 6524 of 2021 arising out of Agamkuan P.R. Case No. E-29/21 instituted for the offences under Section 30(a), 56(b), 32(1), 32(3), 41(1) and 42(2) of the Bihar Prohibition & Excise Amendment Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 10.10.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 200 liters of liquor from an Auto. Learned counsel for the petitioner submits that the petitioner is a driver of the Auto and as such was not knowing
Patna High Court CR. MISC. No.7364 of 2022(2) dt.09-03-2022 2/2 which passenger had kept the liquor in the Auto. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 10.10.2021 is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Special Case No. 6524 of 2021 arising out of Agamkuan P.R. Case No. E-29/21.
