JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Petitioner is languishing in custody since 29.04.2014 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

It is alleged that when the informant came to her house her ten years old daughter Shiwani conveyed that petitioner being relative of the informant has killed her husband and took the dead body for disposal when the dead body was recovered.

It is submitted by learned counsel for the petitioner that daughter of the informant Shiwani who conveyed her about the occurrence has not been examined during investigation. The statement of the son of the victim has been recorded in para 26 of the case diary who has not alleged anything against the petitioner who was also the first person who saw the dead body hanging inside the house.

Patna High Court Cr.Misc. No.36042 of 2014 (4) dt.13-01-2015 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Khizersarai P.S. Case No. 52 of 2014.
