JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The instant case has been registered under various sections of the Arms Act but nothing has been recovered from conscious possession of the petitioner and according to the prosecution case itself, at the time of alleged occurrence petitioner was in jail custody in another case.

No doubt, petitioner carries criminal antecedent of several cases but submission on behalf of the petitioner is that the local police is in habit of implicating the petitioner in false cases and earlier the local police had made attempt to detain the petitioner under Preventive Detention Act but the order of local police was revoked by the government and in retaliation to the

Patna High Court Cr.Misc. No.36396 of 2015 (2) dt.07-09-2015 2/2 above stated fact, petitioner is being implicated by the local police time and again in several cases.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S.Case No. 174 of 2015.
