Petitioner seeks bail in Magadh Medical P. S. Case No. 99 of 2020 registered under Sections 324, 326, 307, and 302 of the Indian Penal Code.
The matter having been considered on merit on 19-07-2021 (Annexure -P/1), learned counsel for the petitioner submits that the period of custody since 27.05.2020 should be considered by this Court and in view thereof, the petitioner should be released on bail.
Earlier, the Court had called for a report from the learned trial Court. Pursuant to which, learned Trial Court (Additional District & Sessions Judge-X, Gaya) has sent a
Patna High Court CR. MISC. No.6621 of 2023(6) dt.12-07-2023 2/2 report dated 11.05.2023.
The report was to the effect that two witnesses out of ten have been examined. The report is of May. The Court is considering the prayer for bail of the petitioner today in July. Learned counsel for the petitioner fairly submits that a couple of more witnesses have been examined in the meanwhile.
Be that as it may, since the trial is in progress, the Court, for the present, is not inclined to allow the petitioner's prayer for bail having regard to the period of custody, in view of the nature of allegations levelled against the petitioner of having stabbed two of the sisters, who happened to be his sisterin-law. The application is rejected.
It is expected that the trial court will proceed in the matter expeditiously without any undue delay or unnecessary adjournments.
