2. The present MJC is pending consideration for the last about seven years. MJC for restoration is filed to recall the order dated 11.08.2003 passed in LPA No. 223 of 1998. Whereas, earlier MJC No. 912 of 2012 was filed and it was dismissed for non-compliance of peremptory order on 13.08.2012, in the absence of recalling order dated 11.08.2023 passed in MJC No. 912 of 2012, the present MJC No. 2316 of 2017 is not maintainable.

3. Accordingly, the present MJC No. 2316 of 2017

Patna High Court MJC No.2316 of 2017(2) dt.02-04-2024 2/2 stands dismissed with cost. Cost is quantified at Rs. 5000/- (Rupees Five Thousand Only). Cost shall be remitted in the Patna High Court Legal Services Committee within a period of eight weeks' from today.
