Petitioner is in custody connection with Piprahi P.S. Case No. 123 of 2019 for the offence under section 379 of the Indian Penal Code and later on Section 379/411 and 120(B)/34 of the Indian Penal Code was added.

It is alleged that petitioner was involved in theft of motorcycle but he was not named in the FIR. Name of the petitioner surfaced on the confessional statement of co-accused Kundan Kumar.

Learned counsel submits that Kundan Kumar has already been granted bail vide order dated 25.11.2019 in Cr. Misc. No. 76034 of 2019.

The petitioner is in custody since 19.09.2019.

No.5054 of 2020(2) dt.31-01-2020 2/2 Considering the fact that petitioner was not named in the FIR and person on whose confessional statement, the petitioner has been made accused, has been granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Judicial Magistrate, 1st Class, Sheohar, in connection with Piprahi P.S. Case No. 123 of 2019.
