The petitioner has preferred this application for grant of regular bail in a case registered under sections 8(b), 15(b) and 18(b) of the N.D.P.S. Act, 1985.

As per the prosecution case, it is stated that opium plants were found cultivated over 2 decimals area of land belonging to the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He has no criminal antecedent and is in custody since 12.12.2020. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and

No.17467 of 2021(4) dt.15-12-2021 2/2 taking into consideration the facts of the case, the petitioner not having any criminal antecedent and having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Fatehpur P.S. Case no.3 of 2020 (Special Case no.4 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cumSpecial Judge (NDPS Act), Kishanganj.
