2. The petitioner seeks bail in connection with Nardiganj P.S. Case No. 241 of 2025 registered for the offence punishable under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita.

3. The petitioner is the husband of the deceased. He is alleged to have killed the deceased.

4. The petitioner is in custody since 19.07.2025 having clean antecedent.

5. Learned counsel for the petitioner submits that the deceased was mentally ill and she was being treated at different places including Central Institute of Psychiatry, Kanke, Ranchi and on the date of death also she was treated.

6. From the postmortem report, it appears that she has committed suicide as there is no external injury except the ligature mark.

7. Learned counsel for the informant has vehemently opposed the prayer for bail.

8. Considering the period of custody, the medical records of the petitioner and also the fact that in the trial also no progress has been made, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Nawada/ concerned Court below in connection with Nardiganj P.S. Case No. 241 of 2025.

10. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
