JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Raghunathpur P.S. Case No. 95 of 2018, arising out of Complaint Case No. 408 of 2018, registered for the offences punishable under Sections 341, 323, 498A, 120B, 420, 504, 506 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Allegation against the petitioner is of subjecting his wife, opposite party No.2, to cruelty with respect to demand of dowry and also assaulting her and torturing by her in-laws and further ousting her from the house.

Submission of learned counsel for the petitioner is that the allegation of torture is against father-in-law and motherin-law and there is general allegation against the petitioner and further he is still ready to keep her with dignity and care. In this case notice was issued to opposite party No.2

Patna High Court CR. MISC. No.7727 of 2019(5) dt.01-05-2019 2/2 and from the order dated 22.4.2019 it appears that registered notice was received by opposite party No.2 but none appeared on her behalf and as such the matter was adjourned. Today also none appears on behalf of opposite party No.2. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan, in connection with Raghunathpur P.S.Case No. 95 of 2018, arising out of Complaint Case No. 408 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation as well as in the disposal of the trial.
