2. Learned counsel appearing on behalf of the petitioner informs that all the retiral dues on different heads, as claimed by the petitioner, has been paid, however, as the
Patna High Court CWJC No.2131 of 2023 dt.01-08-2023 2/2 petitioner was not granted financial upgradation as a result of which benefit of MACP to the husband of the petitioner and pension could not be fixed at the applicable rate of financial upgradation. The sanctioning authority has sanctioned after calculating correct pay scale and sanctioned the pension to be fixed by the Accountant General, Bihar.
3. Considering the development which has taken place during the pendency of the writ petition, the Accountant General, Bihar is directed to forthwith issue the Authority relating to the family pension of the petitioner. The Treasury Officer must ensure to credit the amount into the account of the petitioner within 2-3 days the date he receives the authority slip from the Accountant General, Bihar.
4. With the above observations and directions, the writ petition stands disposed of.
