The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 324, 34 of the Indian Penal Code. The prosecution case as per F.I.R is that informant's son Rahul Kumar went to Chhatauni Chowk to purchase the house hold articles to celebrate Chhath Puja, where the petitioner and others surrounded him and co-accused Dhiraj Kumar assaulted the informant's
Patna High Court CR. MISC. No.6071 of 2022(2) dt.03-08-2022 2/3 son by a knife on his back. It is the case of the informant that his son Rahul Kumar went for a party about two days ago where he had an altercation with the accused persons.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The specific accusation of stabbing the son of the informant is against co-accused Dhiraj Kumar.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S. Case No. 160 of 2021, subject to the conditions as laid down
