JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-02-2019 Heard learned Counsel for the parties concerned. It is the petitioner's case that he is the owner of a land, which has been acquired by the State Government for the purpose of construction of a road. It is his case that he is entitled to compensation at the rate applicable to commercial lands. It is also stated that the petitioner has already received an amount of Rs. 3,31,983/- as house compensation and Rs. 44,091/- as land compensation. He has raised his grievance that he was entitled for higher amount, treating his land so acquired to be commercial land before the Principal Secretary, Land Reforms Department, Government of Bihar. It is also being argued that

Patna High Court CWJC No.2422 of 2019(2) dt.08-02-2019 2/2 the Collector, Bhojpur, was directed by the Divisional Commissioner, Patna, to submit a report, through letter, dated 01.09.2018, but till date, the Collector has not submitted any report.

I have perused the representation, which the petitioner is said to have filed before the Principal Secretary, Land Reforms Department, Government of Bihar. No grievance has been raised in the said representation that the petitioner was entitled for compensation at commercial rate. This application, in my view, is frivolous and deserves to be dismissed.

This application is, accordingly, dismissed.
