The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 323, 324, 325, 307, 379, 504/34 of the Indian Penal Code. The allegation against the petitioner along with coaccused persons is that they armed with lathi, danda, came at the shop of the informant and started assaulting due to which one Manish Kumar Singh sustained injury. It is further alleged that they also looted chain worth of Rs. 50,000/- and cash of total 50,000 from shop of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

There is no specific allegation of assaulting attributed against the petitioner rather general and omnibus allegation attributed against him. There is case and counter case between the parties and both parties sustained injuries in separate occurrence. It is further submitted that the petitioner is languishing in judicial custody since 09.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sangrampur P.S. Case No. 283 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari-I East Champaran.
