The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 108 litres of liquor was recovered from a motorcycle on which the petitioner was also riding and the petitioner was taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner who has been falsely implicated in the case because of his antecedents, details of which have been given in the supplementary affidavit filed on behalf of the petitioner. The petitioner is neither the owner of the alleged motorcycle nor does he have any concern with the seized liquor.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Bairgania P.S. Case no. 184 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II - cum - Special Judge, Excise, Sitamarhi.
