The petitioner apprehends his arrest in a case registered for the offence punishable under Section 302, 120B/34 of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, due to old animosity, this petitioner alongwith other accused persons shot dead husband of the informant.

Learned counsel for the petitioner submits that there is general and omnibus allegation against this petitioner and only due to old animosity, he has been made accused in this case. Informant is not eye-witness to the occurrence and none of the local witness identified the petitioner during investigation. However, learned A.P.P. for the State opposes the

Patna High Court CR. MISC. No.6880 of 2022(2) dt.01-08-2022 2/2 prayer for anticipatory bail and submits that petitioner is named in the FIR and there is specific allegation that he along with other accused persons committed the murder of the husband of informant due to old animosity.

Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on anticipatory bail and same is accordingly rejected.
