JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-04-2019 Though the matter has been listed under the heading 'For Orders on Office Notes' with certain notes of the Registry pointing out the defect in the writ application, considering the nature of dispute the matter has been heard on merit. I have heard learned counsel for the petitioner and learned counsel appearing on behalf of the State-respondents. The petitioner is seeking a direction to the respondents to hold an impartial inquiry regarding payment of compensation with respect to the land acquired in Village

Patna High Court CWJC No.7005 of 2019(2) dt.08-04-2019 2/2 Chilhos and pay to the petitioner an amount of compensation against acquisition of his land treating the same to be commercial in nature.

The petitioner has annexed a representation in the writ application, which, he claims to have filed before the Principal Secretary, Land Reforms and Revenue Department, Government of Bihar. It does not appear that he ever raised any claim in his representation that the land belonging to him, as being claimed by him, was commercial in nature.

It seems that this case is covered by an order, dated 08.02.2019, passed by this Court in C.W.J.C. No. 2406 of 2019 (Chandrama Sharma Vs. The State of Bihar and Ors.). This application is, accordingly, dismissed in terms of the aforesaid order, dated 08.02.2019, passed in C.W.J.C. No. 2406 of 2019.
