The petitioner seeks regular bail in connection with Kajra PS case no. 67 of 2020 instituted for the offences punishable under Sections 25(1-A)(1-AA)(1-AC)/25(1b)A/26/35 of Arms Act. The allegation is regarding the police force having raided the basa (hut) of the petitioner on 13.06.2020, situated at village-Pokhrama, upon having received secret information that the petitioner and his friends were planning to commit some crime, whereupon search was made and one countrymade pistol, one live cartridge and four used cartridges were recovered.
The learned counsel for the petitioner submits
Patna High Court CR. MISC. No.6877 of 2022(3) dt.02-01-2023 2/2 that the petitioner is innocent, has been falsely implicated in the present case and is languishing in custody since 08.10.2021. It is further submitted that the petitioner is accused in two other cases but he is on bail in both the cases. It is also submitted that the petitioner has been suitably punished, considering the period of his incarceration.
Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record as also considering the fact that the petitioner is languishing in custody since more than a year, I deem it fit and appropriate to enlarge the petitioner on bail. Accordingly, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st class, Lakhisarai in connection with Kajra PS case no. 67 of 2020. (Mohit Kumar Shah, J) rinkee/- U T
