Petitioners apprehend arrest in connection with Complainant Case No. 113 (C) of 2006 filed for the offence punishable under sections 323, 147, 148, 392 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to previous enmity. There is land dispute between the parties. Moreover, for such an offence under section 392
Patna High Court CR. MISC. No.16869 of 2021(3) dt.13-01-2022 2/2 I.P.C. and 27 of the Arms Act, complaint case has been filed instead of lodging a regular first information report. Petitioners have been dragged in this case due to local politics.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna in connection with Complaint Case No. 113 (C) of 2006 subject to the conditions laid down under section 438(2) Cr.P.C.
