JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 16.04.2014 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Accusation is of robbing the motorcycle of the informant.

The name of the petitioner sprang up during investigation, though it submitted by the learned counsel for the petitioner that no recovery has been made from the possession of the petitioner nor he has been put on Test Identification Parade. Statement to that effect has been made in paragraph 10 and 13 of the petition. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Patna High Court Cr.Misc. No.36339 of 2014 (4) dt.13-01-2015 that the robbed mobile has been recovered from the possession of the petitioner, though it is claimed by the petitioner that the recovered mobile belongs to the petitioner as stated in paragraph 12 of the petition.

Considering the above facts, the petitioner is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kuchaikote P.S. Case No. 53/2014, G.R. No. 578 of 2014.
