Petitioner's prayer for bail was earlier rejected by this Court in this case registered under Sections 323, 337, 307, 504 and 302 of Indian Penal Code.

It is submitted by the petitioner's counsel that the petitioner has been falsely implicated due to family feud. It is further submitted that on the basis of such false implication, the petitioner has been rotting in jail since 01st of January, 2018. It is also submitted that there is no eye witness to the occurrence and that for extraneous consideration, the petitioner has been implicated.

The application for bail, earlier filed by the petitioner,

Patna High Court CR. MISC. No.6664 of 2019(2) dt.24-04-2019 2/2 being Cr Misc No 17630 of 2018, was rejected on 03.05.2018. This Court, having gone through the case diary, had examined the statements and recorded that specific allegation of assaulting the brother of the informant was supported by the prosecution witnesses examined during course of investigation. Considering the heinous nature of allegation, for the present, this Court is not inclined to allow the prayer for bail. The same is rejected.

It goes without saying that the trial Court should take all possible steps to ensure expeditious disposal of the case without unnecessary adjournments or undue delay. (Madhuresh Prasad, J) M.E.H./- U T
