JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under sections 414/420/34 of the Indian Penal Code read with sections 12 and 20 of the NDPS Act and sections 11/13 of the Bihar Bengal Juaa Act.

As per the prosecution case, 200 grams Ganja, one motorcycle and materials of lottery and four register recording lottery activities were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that only small quantity of contraband has been recovered from this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused. No incriminating article has been recovered from his possession.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.7904 of 2023(2) dt.18-04-2023 2/2 bail submits that the petitioner has got criminal antecedent. Considering the aforesaid facts, prayer for bail of the petitioner is refused.
