JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-09-2022 At the outset, the learned counsel for the petitioner has submitted that the amount quantified as the deficit stamp duty, by the impugned order dated 15.11.2017, passed by the Assistant Inspector General of Registration, Darbhanga Division, Darbhanga in Stamp Case no. 49 of 2017-18, along with the fine stipulated therein, totalling to a sum of Rs. 1,48,035/- shall be paid by the petitioner, hence, the respondent authorities be directed not to take any further action. It is also submitted that the petitioner is an old lady, hence, she does not want to litigate the matter any further, thus the interest be

The learned counsel for the respondent- State has submitted that in case, the petitioner is ready to deposit the amount quantified by the impugned order dated 15.11.2017, the State Authorities shall not pursue the matter any further. Having regard to the facts and circumstances of the case and considering the genuine and valid offer made by the learned counsel for the petitioner as also in the interest of justice and considering the fact that the petitioner is an old lady, who is ready to pay the deficit stamp duty along with the fine, I deem it fit and appropriate to direct the petitioner to deposit the total amount quantified in the impugned order dated 15.11.2017 i.e. a sum of Rs. 1,48,035/-, within a period of four weeks from today, pursuant whereof, the respondents shall be debarred from either recovering any further amount or taking any coercive action against the petitioner herein.

The writ petition stands disposed off on the aforesaid terms.
