Petitioner was initially appointed as Assistant Teacher in Basic School Chandrahati Kamtaul, Muzaffarpur on 21.10.1975 and he was superannuated on 31.1.2012. The claim of the petitioner in the present application is that petitioner was entitled to grant of ACP in terms of ACP rules but the respondents have not granted the benefit of ACP to the petitioner.

Considering the fact that petitioner has superannuated, the writ petition is disposed of with a direction to the

Patna High Court CWJC No.3875 of 2020(2) dt.25-02-2020 2/2 respondents to examine the record and if it is found that the petitioner was eligible in terms of ACP rules for grant of ACP, the same should be extended to the petitioner. Necessary decision for grant of ACP with all consequential benefits may be taken by the respondents at the earliest, preferably within a period of sixty days from the date of receipt/production of a copy of this order.
