JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-04-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has filed the instant application for grant of regular bail in connection with Rajapakar (Baranti O.P.) P.S. Case No. 157 of 2022 registered under sections 147, 341, 323, 324, 307, 354, 379, 504 and 506 of the Indian Penal Code.
Allegation against the co-accused persons including this petitioner is that they assaulted and abused the informant. Further alleged that when informant's aunt came to save the informant then the petitioner assaulted her due to which her clothes tattered.

He has falsely been implicated in this case due to village politics. It is further submitted that the allegation levelled against the petitioner is only assaulting the informant's aunt by means of fists and slaps. There is no specific overt act of allegation of assaulting the informant and his family members by means of weapons against the petitioner rather the specific allegation of assaulting by means of farsa and iron rod is levelled against co-accused persons.
It is also submitted that the injuries sustained by the injured is simple in nature as per injury report and the injury is caused by sharp cutting weapons which is not corroborated with the allegation levelled against the petitioner of assaulting with fists and slaps. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Rajapakar (Baranti O.P.) P.S. Case No.
