Petitioner Nos. 2 and 3 are already in jail.
Hence, their prayer for anticipatory bail is dismissed as infructuous.
Heard learned counsel for petitioner Nos.1and 4 and learned Additional Public Prosecutor for the State. Petitioner Nos.1 and 4 are apprehending their arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,504,307,379,325 of the Indian Penal Code and 27 of Arms Act.
Patna High Court CR. MISC. No.16721 of 2021(2) dt.23-11-2021 2/3 Petitioner No.1- Ram Narayan Singh allegedly caused injury at the head.
Since petitioner No.1-Ram Narayan Singh had knowledge that his act might cause death, I am not inclined to enlarge him on anticipatory bail. Accordingly, prayer is refused. Petitioner No.4-Reena Devi does not bear any allegation of commission of assault rather ornamental allegation of commission of theft. She has got no criminal antecedent. Learned counsel for the informant opposed the prayer for anticipatory bail.
Let petitioner No.4, above named, in the event of her arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Rajpur P.S. Case No.185 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as subject to the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below.
(b) Petitioner No.4 shall fully cooperate with the
Patna High Court CR. MISC. No.16721 of 2021(2) dt.23-11-2021 3/3 investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of petitioner No.4. (c) Petitioner No.4 shall not leave the country without permission of the learned Trial Court.
