Petitioner happens to be husband of the deceased and is languishing in jail custody since 13.9.2013 in a case initially registered under section 304B/34 of the IPC but after investigation, police submitted charge sheet under sections 306 and 201 of the IPC. The cognizance has been taken under sections 306 and 201 of the IPC. Although in course of investigation, it came to light that prior to death of the deceased, she was beaten by the petitioner badly but taking note of the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Patnacity in Sessions Trial no. 320/2014 arising out of Fatuha P.S. Case no. 160/2013 subject to the condition that petitioner shall attend the learned trial court in person on each and every date for the period

Patna High Court Cr.Misc. No.39238 of 2014 (4) dt.04-03-2015 of one year or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any reasonable explanation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
