JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel, appearing for the informant.
Petitioner happens to be husband of the deceased who died within six months of her marriage in other than normal circumstances but the written report of the informant does not contain the allegation of illegal demand as well as torture and it is only stated that the deceased was administered poison by petitioner and other family members as petitioner had illicit relation with his Bhabhi.
No doubt, the informant claimed that before death, deceased disclosed that poison was administered to her by petitioner and other accused but admittedly, the in-laws of the
Patna High Court Cr.Misc. No.37486 of 2015 (3) dt.05-11-2015 2/2 deceased have already been admitted to anticipatory bail by a coordinate bench of this court.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Piprakothi P.S. Case No. 163 of 2014 to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari.
