The petitioner seeks bail in a case registered for the offence under Sections 399, 402, 414 of the I.P.C., Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8, 20(b)(ii)(c) of the N.D.P.S. Act.

One loaded country-made pistol, one live cartridge and one mobile phone have been recovered from the possession of the petitioner.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent and he is in custody since 26.11.2021.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge / Special Judge, Motihari, East Champaran in connection with N.D.P.S. Case No. 113 of 2021, arising out of Ghorasahan P.S. Case No. 501 of 2021.
