The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 504, 506, 307, 427, 353, 283, 332 and 333 of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage to Public Property Act, 1984.
As per prosecution case, the informant alleges that accused persons including the petitioners were protesting on road with a dead body of Jitendra Kumar and created ruckus, even blocked the road causing traffic jam and thus created obstruction in discharge of official duty.
Learned counsel for the petitioners submits that no
Patna High Court CR. MISC. No.7860 of 2023(2) dt.13-04-2023 2/2 such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that petitioners are only member of mob. Similarly situated co-accused, have been enlarged on bail by a co-ordinate bench of this court vide order dated 06.12.2022 passed in Cr. Misc. No. 38749 of 2022. Petitioners No. 1 and 3 has one criminal antecedent and petitioner no. 2 has got two criminal antecedents as mentioned in para-3 of this application.
Learned APP for the State opposes prayer for anticipatory bail.
Considering the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Gaurichak P.S. Case No. 276 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) anand/- U T
