JUSTICE SATYAVRAT VERMA ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State. No one appears on behalf of the informant. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363/365 of the Indian Penal Code.
Learned counsel for the petitioner at the outset submits that the informant had instituted a case of kidnapping but it was a case of elopement as the victim and Tanvir Azam were in love. It is next submitted that from perusal of Annexure '4' to the anticipatory bail application it would manifest that the parties have compromised the case and the victim has been happily married to Tanvir Azam.
Learned A.P.P. for the State submits that if what has been submitted by the learned counsel for the petitioner is true
Patna High Court CR. MISC. No.6609 of 2022(3) dt.06-07-2022 2/2 and the compromise has been entered by the father of the victim along with victim with the petitioner then in that event he does not oppose the anticipatory bail of the petitioner but then the matter should be verified.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sasaram Nagar P.S. Case No. 405 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Further the learned court below shall ensure that the compromise entered in between the informant and the petitioner has been entered without any coercion, force or duress and if the informant informs the court that he has compromised the case on his own volition, the present order be acted upon.
