JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be brother of the deceased whose dead body was found hanging in an orchard. The present case was lodged by father of the petitioner against Sikandar Mahto and Ram Sagar Mahto. The FIR named accused, Sikandar Mahto had sweet relation with the deceased and at para-22 of the case diary, the wife of Sikandar Mahto admitted this fact that after missing of the deceased, her father came at her home and enquired about the deceased. Moreover, none has seen the actual killing of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.36864 of 2015 (3) dt.03-11-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Manjhi P.S. Case No. 22 of 2015.
