In this case, the petitioner is seeking regular bail in connection with P.O.C.S.O. Case No.07 of 2015, arising out of Begusari P.S. Case No.104 of 2015, registered for the offence under Sections 363, 365, 366A, 372, 373, 370A and 120B/34 of the Indian Penal Code, under Section 3, 4, 5, 6 and 7 of the I.P.P. Act and under Section 4/8 of the P.O.S.C.O. Act. Allegation has been made that the petitioner and others are running a brothel house and from the said house certain minor girls were recovered. Three girls have given their statements under Section 164 of the Cr.P.C. They have identified the name of three different and distinct women to whom these girls were sold and they were forced to go for prostitution against

Patna High Court Cr.Misc. No.56636 of 2015 (3) dt.05-02-2016 2/2 their wish.

The petitioner is in jail since 26.2.2015. Looking to the period of custody, let the petitioner-Lalo Devi be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-1-cum-Special Judge, Begusaria, in connection with P.O.C.S.O. Case No.07 of 2015, arising out of Begusari P.S. Case No.104 of 2015, subject to the conditions that:- (i) one of the bailors will be a close relative of the petitioner;

(ii) If the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to make prayer for cancellation of his bail and the Court below will pass necessary order, including cancellation of bail and;

(iii) that the petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel the bail bonds of the petitioner.
