ANJANA MISHRA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by the learned counsel for the informant.

The petitioner is in custody since12.7.2014 in Ladaniya P.S. Case No.41/14 for the offences under Sections 341, 323, 307, 337, 354 and 509/34 of the I.P.C.

It is submitted on behalf of the petitioner that though the allegation against the petitioner is that he deliberately attacked the informant who had undergone an operation recently and was carrying a bag on account of surgical interference, with clear intention of endangering his life. It is further submitted that the petitioner and the informant's family members are agnates and it was only on account of some altercation

Patna High Court Cr.Misc. No.38149 of 2014 (4) dt.08-01-2015 2/2 regarding some family dispute such occurrence took place.The petitioner further submits that he has already been in custody for almost six months and, hence, he may be extended the privilege of bail.

Considering the aforementioned submissions and the fact that the entire occurrence had occurred on account of her family feud and that the petitioner is willing to cooperate in the trial, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Madhubani, in G.R.No.1092/14 arising out of Laldaniya P.S.
