Petitioner seeks bail in connection Dagrua P.S. Case no. 234 of 2020 registered for the offence punishable under sections 272, 273 of the Indian Penal Code read with section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is person with clean antecedent and is in custody since 21.12.2020 and charge sheet has been submitted. He next submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that 1118.04 liter foreign liquor was recovered from Tata 407 Pickup van. He further submits that van does not belong to the petitioner and he is driver of the said van and he was not aware what was being carried in the van.

Patna High Court CR. MISC. No.22970 of 2021(2) dt.16-11-2021 2/2 Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is person with clean antecedent and is in jail custody since 21.12.2020 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Purnea in Dagrua P.S. Case no. 234 of 2020.
