JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-11-2018 After some arguments, the learned counsel for the petitioner seeks to withdraw the present writ petition with liberty to file objection under Section 9 of the Bihar & Orissa Public Demands Recovery Act, 1914 and till then the petitioner seeks protection.

Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file objection under Section 9 of the Bihar & Orissa Public Demands Recovery Act, 1914 before the Certificate Officer, Bhagalpur in connection with Certificate Case No. 11 of 2010-11, which shall be considered by the Certificate Officer and then a final order be passed.

However, it is made clear that in case no objection is filed by the petitioner within four weeks from today, the Certificate Officer, Bhagalpur, shall proceed and pass ex parte order.
