The petitioner apprehends his arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per the F.I.R., on 09.05.2021, this petitioner alongwith two co-accused persons barged into the house of informant and started abusing her as to why she had gone to lodge complaint against them and thereafter, it is alleged that petitioner alongwith other two co-accused assaulted the informant and her daughter causing injury to them. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case because of old rivalry. As per injury report, injuries are simple in nature (Annexure 2 and 2/A). Section 379 of the I.P.C. has been added in F.I.R. only with a view to make the offence serious.

Patna High Court CR. MISC. No.6587 of 2022(2) dt.01-08-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J,M., Banka in connection with Dhoraiya P.S. Case No. 107 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
