2. A prayer for bail has been made on behalf of the petitioner in connection with Forbesganj P.S. Case No.574 of 2024 registered for the offence under section 21(c) of the NDPS Act.

3. As per F.I.R, there is a recovery of 19.900 litres of cough syrup from a sack kept in a red coloured scooty driven by the petitioner who was arrested on the spot.

4. It is submitted by learned counsel for the petitioner that the recovery has not been made from the physical or conscious possession of the petitioner and he is not the owner of the alleged scooty. It is only due to previous criminal antecedent, the petitioner has been made an accused in the present case. He

Patna High Court CR. MISC. No.9547 of 2025(3) dt.29-05-2025 2/2 further submits that there is no independent witness to the seizure list indicating violation of manadatory provisions of both B.N.S.S and NDPS Act. The petitioner is in custody since 13.09.2024 and undertakes to co-operate in the case/trial. Charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State on the ground that petitioner is an accused in one case. In response, learned counsel for the petitioner submits that he is on bail in the said case.

6.Taking into consideration the facts of the case, the petitioner is directed to be enlarged on bail in connection with Forbesganj P.S. Case No.574 of 2024 on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below where the case is pending/successor Court.
