This application for anticipatory bail arises out of Nawanagar P.S. Case No. 217 of 2018 for the offence under Sections 341, 323, 324, 379 and 504/34 of the Indian Penal Code and Section 8 of POCSO Act.

It is alleged that the accused persons for the purpose of outraging the modesty of the informant assaulted her with slaps and fists and dragged her out of her house at about 11 AM. It is also alleged that the accused persons assaulted the informant and her sisters.

From the First Information Report, in my view, it appears that the allegation of intention of outraging the modesty

Patna High Court Cr.Misc. No.9616 of 2019(2) dt.18-02-2019 2/2 suffers from absurdity. There is also allegation of snatching certain golden ornaments Be that as it may, in the facts and circumstances, a case for grant of anticipatory bail is made out. This application is accordingly allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-1st-cum-Special Judge, Buxar, in Nawanagar P.S. Case No. 217 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
