The petitioners are languishing in custody since 29.11.2018 in connection with Ahiyapur P.S. Case No.1262 of 2018 registered for the offences punishable under Sections 20, 22 of N.D.P.S. Act.

Prosecution case as per the FIR is that from the shop of the petitioner, 430 grams of Ganja were recovered. It is submitted by learned counsel for the petitioner that the recovery is of small quantity and statement has been made in para 3 of the bail application that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.6292 of 2019(2) dt.05-02-2019 2/2 Learned A.P.P. has vehemently opposed the prayer for bail and submits that the recovery has been made from the shop of the petitioner.

Considering the recovery of small quantity and statement made in para 3 of the bail application to the effect of having no criminal antecedent, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (N.D.P.S. Act) Muzaffarpur in connection with Ahiyapur P.S. Case No.1262 of 2018.
