The petitioner seeks regular bail in connection with Muzaffarpur Town P.S.Case no.978 of 2019 registered for offences punishable under Sections 30(a), 38 and 41 of the of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 125 ltrs. of foreign liquor from the house of the petitioner. Submission of the learned counsel for the petitioner is that house is a joint house, having no criminal antecedent and he is in custody for more than two months. Charge-sheet has already been submitted and there is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge (Excise) Muzaffarpur in connection with Muzaffarpur Town P.S.case no.978 of 2019.

With the aforesaid observation, this application is allowed.
