2. Heard learned counsel for the petitioners and learned

Patna High Court CR. MISC. No.7108 of 2025(5) dt.15-09-2025 2/3 APP for the State.

3. The petitioners are apprehending their arrest in Kishanpur P.S. Case No. 261 of 2022 registered under Sections 341, 323, 498(A), 376, 504, 506 and 34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

4. As per the prosecution story, the informant alleges that her marriage was solemnized in the year 2021 with Md. Yunus. The customary presents were given. But after marriage, the accused persons started torturing the victim for non-fulfillment of demand of dowry. She further alleges some filthy allegation against her father-in-law, Md. Rizwan.

5. Learned counsel for the petitioners submits that the relationship between both the parties was not cordial that is why, they decided to reside separately and they entered into an agreement dated 07.10.2022 which is Annexure-2.

6. From perusal of Annexure-2, it appears that petitioner and his wife, Opposite Party No. 2 mutually decided to live separately and the petitioner assured to return her articles and Rs.90,000/-. The agreement is duly signed by the petitioner, Md. Yunus, his wife and the family members of both sides.

7. Learned APP for the State opposed the prayer for bail of the petitioners.

8. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Kishanpur P.S. Case No. 261 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
