JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-07-2023 The present writ petition has been filed seeking the following reliefs:- "(A) For issuance of a writ in the nature of mandamus directing and commanding the Respondents to promote the Petitioner on the post of Branch Manager from the post of Assistant as In-charge Branch Manager and consequential other promotions.

(B) For issuance of a writ in the nature of mandamus directing and commanding the Respondents to give monitoring benefit to the Petitioner from his promotion has been due with appropriate interest."

At the outset, the learned counsel appearing for the

Patna High Court CWJC No.15200 of 2014(2) dt.13-07-2023 2/2 respondents no.4 and 5 i.e. the District Central Co-operative Bank, Aurangabad, has submitted that the petitioner has already been dismissed from service and his service appeal is pending adjudication bearing Service Appeal No.83 of 2021. In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to agitate his aforesaid grievances, in case he succeeds in the appeal, filed before the respondent authorities. Liberty so sought is granted. The writ petition stands disposed off.
