The petitioner is languishing in custody since 01.08.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
The accusation is of assaulting the informant and his son.
It is submitted by learned counsel for the petitioner that the specific accusation of making assault to the informant's son is against Md. Tanbir Son of Md. Taiyab whereas the petitioner is Md. Tanbir Alam Son of Md. Wasil Ansari, but treating the petitioner as Md. Tanbir who caused grievous injury to
Patna High Court Cr.Misc. No.36755 of 2014 (03) dt.15-01-2015 2/2 the son of the informant, the prayer for bail of the petitioner has been rejected. This fact has been elaborated in para 17 of the petition that it is an error of record.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Banmankhi P.S.
