The petitioner is seeking anticipatory bail in connection with Fulwaria P.S. Case No. 169/2018 registered under Sections 363, 366(A)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the informant of the case had falsely implicated this petitioner on mere suspicion as her daughter went missing on 15.07.2018. Learned counsel submits that the victim girl has recovered and her statement under Section 164 Cr.P.C. was recorded. She has denied any occurrence of kidnapping. In fact the victim girl has stated that she had got low marks in study and she did not want to study and had left the house due to fear of the family. Learned A.P.P. for the State is present and has

Patna High Court Cr.Misc. No.8631 of 2019(2) dt.18-02-2019 2/2 opposed the prayer of anticipatory bail of the petitioner. Considering the facts and circumstances of the case particularly the statement of the victim girl under Section 164 Cr.P.C. this court is willing to extend the benefit of anticipatory bail to the petitioner, in the event of his arrest/surrender before the court below within a period of four weeks, let the abovenamed petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XIII, Gopalganj, in connection with Fulwaria P.S. Case No. 169/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
