Petitioner seeks bail in Beur P.S. Case No. 319 of 2018 registered for the offences punisbahle under Section 379 of the Indian Penal Code and later on police submitted chargesheet under Sections 379, 411, 413 and 414 of the IPC. Informant has alleged that on 06.10.2018 at about 8:00 P.M. in the night he parked his truck near Saristabad and went to sleep at his house because all the family members had gone to attend the last rites of his uncle. On 07.08.2018 when he came to the parked place, he found his truck was stolen and even after much search, it was not traced out. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case and his name has surfaced in this case on his own self confession. He is owner of Garage and nothing was recovered from his Garage.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-JudgeVIII-cum-A.C.J.M., Patna, in connection with Beur P.S. Case No. 319 of 2018 with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
