The petitioners being parents of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 494, 504/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand and performing second marriage by the husband of the informant.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the entire inlaws family including the petitioners. Moreover, the thrust of accusation is against the husband of the informant. The impugned order reflects that the matter was referred to the mediation centre
Patna High Court Cr.Misc. No.25225 of 2016 (2) dt.20-06-2016 2/2 by the learned Court below for reconciliation but the mediation failed. Though, the husband of the informant is ready to keep her with full dignity and honour.
Considering the thrust of accusation against the husband of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada, in connection with Hisua P.S. Case No.35/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
